Melissa Bailey recently won a motion to dismiss a UM carrier from litigation in the State Court of DeKalb County.  Melissa argued on behalf of the UM carrier that service outside of the statute of limitations was inappropriate despite the plaintiff’s claim that the service complied with the statute because it learned of the availability of UM funds after the statute had run.  The trial court determined that the plaintiff had failed to exercise the requisite diligence in uncovering coverage and perfecting service prior to the expiration of the statute of limitations and dismissed the UM carrier.
