Mark Lefkow Obtains Summary Judgment for Motorhome Dealer

April 22, 2020

Mark Lefkow obtained summary judgment in Gwinnett County Superior Court for their motorhome dealer client on claims for fraud, breach of contract, and alleged violations of the Fair Business Practices Act. Plaintiff contended that she was deceived into buying a motorhome that had rust underneath it and that contractual charges were added after she purchased the motorhome. We obtained critical admissions at Plaintiff’s deposition that defeated Plaintiff’s claims, including her admission that no one prevented her from looking under the motorhome and that she accepted delivery of the motorhome after noticing the added contractual charges. In a well-reasoned order, the Court granted full summary judgment to our client and dismissed Plaintiff’s action with prejudice.
