Clinton Fletcher obtained the dismissal of a third party claim for tort liability brought against their client by a defendant in a declaratory judgment action.  Clinton argued on behalf of his client that the third party claim were improper as it sought direct liability from the defendant and not derivative liability for the declaratory judgment action as required for proper third party action.  The third party plaintiff ended up agreeing with their argument and the trial court dismissed the third party claim.
