Case Against Family Physician Dismissed Without Payment

Partners Gary Lovell and Lee Weatherly secured a dismissal with prejudice for their client, a family practicing physician, in a Spartanburg, South Carolina medical malpractice case. The Plaintiff was the husband of woman, who died of lung cancer in 2009. Plaintiff claimed that the physician was negligent in reading a 2007 chest x-ray performed as part of routine physical examination. Plaintiff claimed that if the doctor has properly read the deceased’s chest x-ray or sent the x-ray to a radiologist to be over-read, the deceased’s lung cancer would have been diagnosed in 2007 instead of in 2009 and that she would have survived. After aggressively establishing a solid defense for the family physician, Plaintiff agreed to dismiss the case, with prejudice, without payment.
