For more than 30 years, the firm’s Trucking and Transportation Litigation Practice group has counseled and represented intrastate and interstate motor carriers of persons and property, drivers, owner-operators, shippers, freight forwarders, third party logistics providers (3PL’s), insurers, and other transportation related entities throughout Georgia, South Carolina, Alabama, Florida, Tennessee and the Southeast. Our attorneys are experienced and knowledgeable in handing all aspects of claims and losses in the trucking and transportation field. We assist clients with issues involving initial accident investigation and claims, personal injury or wrongful death claims, cargo loss, contribution and indemnification claims, insurance coverage disputes, intermodal contract disputes, federal and state regulatory practices, environmental losses, employment and hiring practices, and workers’ compensation claims. The Trucking and Transportation Litigation Practice group strives to assist clients in resolving claims efficiently and in a cost-effective manner that meets the clients’ goals through pre-litigation investigation assistance and litigation.
We regularly engage in preventative counseling for Trucking and Transportation clients as it relates to changes in Federal regulations, state law, and industry practices. The Trucking and Transportation Litigation Practice Group also advises clients regarding risk management, claims handling practices, and State and Federal Law and Regulatory developments through client seminars, industry seminars, firm publications, and our website.
Attorneys of the firm actively participate in transportation industry organizations, including the Insurance and the Georgia Motor Truckers Association, Transportation Law Section of the ABA, Trucking Industry Defense Association (TIDA), Trucking and Transportation Sub-Committee of the Defense Research Institute (DRI), Intermodal Association of North America, Association of Transportation Law Professional, Transportation Lawyers Association and International Association of Defense Counsel. We also are members of the Trucking Associations of Georgia and South Carolina.
Gary Lovell leads Copeland, Stair, Kingma & Lovell, LLP’s transportation group. The transportation group has a combined 100-plus years of experience investigating, litigating and effectively resolving transportation liability claims and lawsuits both for transportation insurers and large “self-insured” motor carriers.
Gary oversees the firm’s 24 hour emergency response teams for the firm’s transportation clients throughout the Southeast. Gary is among the original attorneys in the United States to formulate and implement the emergency response model that has become the industry standard. Gary has a strong working relationship with highly respected and skilled investigators, adjusters and accident reconstruction experts who specialize in transportation emergency response.
This allows the firm to immediately and effectively manage preservation of vital evidence to include equipment, data downloads, identifying and interviewing witnesses, and working with law enforcement. Just as importantly, we have the experience and understanding to protect the involved drivers during these extraordinarily stressful events and to ensure that they cooperate with law enforcement and effectively participate in the investigative process.
